Welcome to Art for Planet Earth. These Terms of Use (“Terms”) govern your access to and use of our website, services, exhibitions, competitions, and gallery features. By using this website, you agree to be bound by these Terms. If you do not agree, please refrain from using the site.
1. Acceptance of Terms
By accessing or submitting content to Art for Planet Earth, you confirm that you understand, accept, and agree to comply with these Terms. We may update these Terms occasionally, and continued use of the website signifies your acceptance of any changes.
2. Eligibility
You must be legally able to enter into agreements under UK law. By submitting artwork to an open call or participating in competitions, you the artist confirm that:
- You are the creator and copyright owner of the submitted work, or acting on behalf of the creator and copyright owner with their full permission.
- Your submission complies with all applicable laws and these Terms.
- Any required entry fees are paid in full before your artwork is processed for compliance or judging.
- You reside in the United Kingdom and, where the artwork is for sale, it is also in the United Kingdom.
3. Artist Responsibilities
Artists are responsible for ensuring that all information provided is accurate and that their submissions do not infringe the rights of any third party. Art for Planet Earth reserves the right to remove or reject artwork that violates these Terms or appears inappropriate for the platform.
4. Buyer Responsibilities
Buyers are responsible for ensuring that all of the information they provide is accurate.
No shipping costs are included in the sale price so the buyer is responsible for coming to an agreement with the artist on the cost of shipping which will be in addition to the sale price. Once a sale is agreed between the artist and the buyer, the buyer agrees to make a payment promptly via the Monek payment link. Once the buyer has received the artwork the buyer is responsible for notifying us that it has been received and accepted.
For avoidance of doubt, the contract of sale is between the buyer and the artist. Art for Planet Earth facilitates the sale and provides the connection between buyers and artists.
5. Submission Rules & Content Ownership
The artist retains full copyright to their artwork. However, by submitting artwork to Art for Planet Earth, the artist grants us a non-exclusive, royalty-free licence to:
- Display their artwork on our website and associated online platforms.
- Use their submission for promotional purposes relating to competitions, exhibitions, or the Art for Planet Earth brand.
The artist may request removal of their artwork from public display at any time by contacting us. Removal will not affect any rights already exercised before the request was made.
6. Use of Submitted Artwork
Submitted artwork may appear on publicly accessible pages, including open exhibition pagess, invited exhibition pages, competition pages, and archive or promotional listings. Artworks may remain visible after an exhibition or competition ends unless removal is specifically requested by the artist.
7. Competition Terms
Competition entries must be submitted via our online form for open calls and accompanied by any required entry fee. Entry fees are processed securely via Monek's hosted checkout (see monek.com).
Competition-specific rules, deadlines, and judging criteria may vary and will be outlined on the relevant competition page.
8. Fees & Payments
Payments for open calls, competition entries or other services are handled via Monek's secure hosted checkout system. Art for Planet Earth does not store or process payment card details.
A transaction must be completed successfully before an artwork will proceed to the compliance or judging stages.
9. Compliance & Judging Process
Submitted artwork may undergo a compliance check conducted by designated team members to ensure it meets the criteria specified by us. Competitions will be judged by appointed judges, whose decisions are final.
We do not guarantee acceptance, display, or recognition for any submission.
10. Prohibited Content
The artist agrees not to submit artwork or content that:
- Infringes intellectual property rights of others.
- Contains hateful, abusive, or discriminatory imagery or text.
- Depicts illegal activity.
- Violates any applicable law.
We reserve the right to remove or refuse content at our discretion.
11. Intellectual Property Rights
The intellectual property rights of all artwork submissions displayed on our website are owned by the respective artist. All other website content — including text, branding, and design elements — is owned by Art for Planet Earth or its licensors and protected under UK copyright law. You may not copy, reproduce, or redistribute any website materials without written permission.
12. Third-Party Services
Art for Planet Earth uses third-party services, including:
- Monek for payment processing
- Google Analytics for performance and usage tracking
Your use of these services is subject to their respective terms and policies.
13. Privacy Policy Reference
Our handling of personal data is governed by our separate Privacy Policy. These Terms of Use do not override or replace that policy. By using this website, you acknowledge that you have read and understood our Privacy Policy.
14. Limitation of Liability
Art for Planet Earth provides this website on an “as is” and “as available” basis. We make no guarantees regarding continuous availability, accuracy of content, or the outcome of any competition.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential losses arising from your use of the website.
